By engaging our services or using our website, you ("Client," "Customer," or "you") agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

Agreement to Terms: By requesting services, signing a contract, or making payment to Atlas Builders & Development, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, along with any additional terms specified in your service contract.

Capacity to Contract: You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are acting on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

Modification of Terms: We reserve the right to modify these Terms at any time. Material changes will be communicated through our website, email notification, or written notice. Continued use of our services after such modifications constitutes acceptance of the updated Terms.


2. SERVICES PROVIDED

Construction Services: Atlas Builders & Development provides licensed construction and roofing services including but not limited to:

New home construction and custom home building

Home additions, extensions, and renovations

Kitchen and bathroom remodeling

Roofing installation, repair, and maintenance

Emergency construction and roofing services

Commercial construction and renovation projects

Licensed Operations: All services are performed under our valid Florida licenses and in compliance with applicable building codes, safety regulations, and industry standards. We maintain appropriate insurance coverage and bonding as required by law.

Service Areas: Our services are primarily provided within Miami-Dade County and Broward County, Florida. Services outside these areas may be considered on a case-by-case basis for larger projects.

Emergency Services: We provide 24/7 emergency response for storm damage, urgent repairs, and safety-related issues. Emergency service rates and terms may differ from standard service rates and will be clearly communicated before work begins.


3. CONTRACTS AND AGREEMENTS

Written Agreements: All construction projects require a written contract signed by both parties before work begins. The contract will specify project scope, timeline, materials, costs, and payment terms specific to your project.

Estimates and Proposals: Free estimates and proposals are provided for informational purposes and are valid for 30 days unless otherwise specified. Estimates may be subject to change based on site conditions, material costs, or scope modifications.

Change Orders: Any modifications to the original contract scope must be documented in a written change order signed by both parties. Change orders may affect project timeline and total cost.

Permits and Approvals: We will obtain necessary building permits and approvals as part of our services unless otherwise specified. You are responsible for providing access to property and any required documentation for permit applications.


4. PAYMENT TERMS

Payment Schedule: Payment terms are specified in your individual service contract and may include:

Deposit requirements for project initiation

Progress payments tied to project milestones

Final payment upon completion and approval

Emergency service payments (typically due upon completion)

Accepted Payment Methods: We accept cash, checks, credit cards, and financing through our approved lending partners. Payment processing fees may apply for certain payment methods.

Late Payments: Late payments may result in work suspension and additional fees as specified in your contract. We reserve the right to charge interest on overdue amounts at the maximum rate allowed by Florida law.

Financing: Third-party financing is available through our lending partners. Financing terms and approval are subject to credit requirements and lender policies independent of our services.


5. WARRANTIES AND GUARANTEES

Workmanship Warranty: We provide warranties on our workmanship as specified in your individual contract, typically ranging from 1-10 years depending on the type of work performed.

Material Warranties: Material warranties are provided by manufacturers and transferred to you upon project completion. We will assist with warranty claims but are not responsible for manufacturer defects or warranty limitations.

Warranty Exclusions: Warranties do not cover:

Damage caused by normal wear and tear

Damage resulting from acts of nature, accidents, or misuse

Modifications made by others after completion

Failure to perform recommended maintenance

Damage caused by settling, earthquakes, or other natural phenomena

Warranty Service: Warranty service will be provided during normal business hours unless the issue poses a safety hazard. Emergency warranty service may be available at additional cost.


6. LIABILITY AND INSURANCE

Insurance Coverage: Atlas Builders & Development maintains comprehensive general liability insurance, workers' compensation insurance, and appropriate bonding as required by Florida law and industry standards.

Limitation of Liability: Our liability is limited to the contract value of services performed. We are not liable for indirect, consequential, or incidental damages including but not limited to lost profits, business interruption, or personal inconvenience.

Property Protection: We will take reasonable precautions to protect your property during construction. However, construction work inherently involves some risk of damage to existing structures, landscaping, and personal property.

Client Responsibilities: You are responsible for:

Providing safe access to the work area

Removing or protecting valuable items and furnishings

Ensuring pets and family members are kept away from active work areas

Maintaining adequate homeowner's insurance coverage


7. PROPERTY ACCESS AND SITE CONDITIONS

Access Requirements: You grant us reasonable access to your property during normal business hours and as needed for emergency services. Access includes the right to bring equipment, materials, and personnel necessary for project completion.

Site Conditions: Contracts and estimates are based on normal site conditions. Unexpected conditions such as structural issues, hazardous materials, or underground utilities may require additional work at additional cost.

Utility Markings: You are responsible for ensuring all utilities are properly marked before excavation work begins. We will coordinate with utility companies as required by law.

Environmental Considerations: We comply with all applicable environmental regulations. Discovery of hazardous materials may require work suspension and specialized remediation at additional cost.


8. FORCE MAJEURE

Uncontrollable Circumstances: We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to:

Severe weather conditions, hurricanes, and natural disasters

Government actions, permit delays, and regulatory changes

Material shortages and supply chain disruptions

Labor strikes and work stoppages

Acts of terrorism, civil unrest, or public health emergencies

Hurricane Season Considerations: Given South Florida's hurricane risk, projects may experience delays during hurricane season (June 1 - November 30). We will communicate promptly about weather-related delays and work with you to resume services as soon as safely possible.

Notice and Communication: We will provide prompt notice of force majeure events and expected delays. Project timelines will be adjusted accordingly without penalty to either party.


9. DISPUTE RESOLUTION

Good Faith Resolution: We are committed to resolving any disputes through direct communication and good faith negotiation. Most issues can be resolved through open dialogue and mutual cooperation.

Mediation: If direct negotiation fails, disputes will first be submitted to mediation through a mutually agreed-upon mediator or mediation service in Miami-Dade or Broward County.

Arbitration: If mediation is unsuccessful, disputes exceeding $10,000 may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

Legal Action: For disputes under $10,000 or where arbitration is not applicable, legal action may be pursued in the appropriate courts of Miami-Dade or Broward County, Florida.

Attorney Fees: The prevailing party in any dispute resolution proceeding may be entitled to reasonable attorney fees and costs as allowed by law.


10. LICENSING AND COMPLIANCE

Professional Licensing: Atlas Builders & Development operates under valid Florida professional licenses and maintains all required certifications for the services we provide.

Building Code Compliance: All work is performed in accordance with applicable building codes, safety regulations, and industry standards. We ensure proper permits are obtained and inspections are completed as required.

Professional Standards: We adhere to professional industry standards and ethical business practices. Our work is performed by qualified professionals with appropriate training and certification.

Regulatory Compliance: We comply with all applicable federal, state, and local regulations including OSHA safety requirements, environmental regulations, and employment laws.


11. WEBSITE TERMS OF USE

Website Access: Our website is provided for informational purposes and to facilitate communication about our services. Use of our website constitutes acceptance of these Terms.

Intellectual Property: All content on our website, including text, images, logos, and design elements, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or modify our content without written permission.

13. INTELLECTUAL PROPERTY

Project Designs: Custom designs, plans, and specifications created for your project become your property upon full payment. We retain the right to use general design concepts and methods for future projects.

Company Materials: Our business name, logos, marketing materials, and proprietary methods remain our intellectual property and may not be used without written permission.

Third-Party Materials: Architectural plans, engineering drawings, and other materials created by third parties remain the property of their respective creators and are subject to their terms and conditions.


14. GOVERNING LAW

Florida Law: These Terms are governed by the laws of the State of Florida without regard to conflict of law principles. Any legal action must be filed in the appropriate courts of Miami-Dade or Broward County, Florida.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement: These Terms, together with your individual service contract and our Privacy Policy, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.


15. UPDATES AND MODIFICATIONS

Policy Updates: We may update our Privacy Policy or Terms & Conditions to reflect changes in regulations or services. Updates will be posted on this page with the revised date.

Notification of Changes: Material changes to these Terms will be communicated through:

Email notification to current customers

Written notice for active projects

Direct communication for significant changes affecting existing contracts

Continued Service: Continued use of our services after Terms updates constitutes acceptance of the modified Terms. If you disagree with updated Terms, you may terminate services according to your contract provisions.
